Minutes of the Meeting of Lockton Parish Council held on Monday May 12th 2014 at 7.30pm in Lockton Village Hall
Present: Cllrs. Chester Brown, Liz Stead, Jennifer Halmshaw & David Stewart. Clerk Jackie Edenbrow.

The Parish meeting was not required.

Annual Meeting of the Parish Council.

Jennifer Halmshaw proposed that Chester Brown remained as Chairman & David Stewart seconded this. Liz Stead proposed that Jennifer Halmshaw remained as vice-chairman & David Stewart seconded this.

These were agreed & signed as a true record.

A1405/04 Accounts
The Clerk handed out the accounts & summary accounts for the year 2013/14. These were discussed and the Parish Council unanimously accepted the accounts.

1503/04 Matters arising/ ongoing
/01 Undergounding electricity – street lights
The Clerk has spoken to Paul Gilmore at NYCC who has not answered any emails. He said the light would be installed during the 2nd or 3rd week in April but the electricity connection would take place later.
/02 Tree work in churchyard & by Box Tree Barn
This work has now been completed.
/03 Removal of surplus grit bins
There has been no response yet from NYCC Highways.
/04 Elections
There have been several notices which the Clerk has put on the village noticeboard. The Councillors were reminded to hand their forms in to RDC before the final date.

These charges have now been increased & they are available to view on the Park’s website.

Details noted. The Clerk has sent a copy to Geoff Hodgson at Havern Beck Cottage in case he wishes to comment.
/08 NYCC –Changes to the Highway Grass Cutting Service
NYCC have detailed again changes to grass cutting for 2015. They are now offering the option to request a deferred payment. The form was completed stating that Lockton PC would continue to do its own grass cutting & did not want to take up the deferred payment option. The Clerk will email the form.
/09 NYCC –Local & Family History Day leaflet
The Clerk has put this on the village noticeboard.
/10 YLCA – White Rose Update

/11 NY Police – Feb stats

/12 Dept for Communities & Local Government – transparency code for smaller authorities
This document details what the Parish Council now needs to publish online. The Clerk will discuss this with Ray Halmshaw to see if this can be added to the Lockton & Levisham Heritage website.
/13 PKF Littlejohn – audit for 2014/15
The audit need to be completed by June 8th this year. Stephen Broadbent has agreed to audit the accounts again this year.
/14 HM Revenue & Custom – PAYE due
The cheque for the Clerk’s PAYE has now been sent off.

Tarmac opposite cemetery
The contractors doing the road repairs in the village has put the spare tarmac opposite the cemetery. This will break up as it’s just on mud & tractors use this track. The Clerk has contacted C Cllr Janet Sanderson & NYCC Highways about this & has requested its removal.
/02 Printer
The printer is not working very well at all now. In the near future new ink cartridges will be needed costing about £350. After some discussion about the various options such as buying a new printer, colour or black & white, an offer of an obsolete black & white laser printer was made. This will be looked into before the next meeting.

1503/09 Date of next meeting 
The next meeting will be the Annual meeting & will be after the elections. A date of May 11th was proposed but may need to be changed depending on the Parish Council elections & which Councillors can attend on that date.

1502/04 Matters arising/ ongoing
/01 Undergounding electricity – street lights
The Clerk has spoken to Nicki Lishman at RDC who advised emailing Leon Raymond at NYCC. The Clerk has only recently done this & has not had a response yet.
/02 Hedge next to cricket field
This work has now been completed. 
/03 Tree work in churchyard 
David Bayes is shortly coming to Lockton to do some tree work for a resident. He hopes to do this work in the churchyard at the same time. Chester said that the trees in the Howl which were cut down a few years ago are now in need of trimming. The Clerk will ask him to do these at the same time.
/04 Lockton Tea Rooms – Facebook
Janilaine had emailed to say she had not had time to prepare any Facebook details for this meeting & would try to attend the March meeting. The legalities of the ownership of a Facebook page was discussed & it was felt that there had to be careful consideration given to content. 

1502/05 Correspondence 
/01 NYMNP – Yorkshire Derwent Catchment partnership
It was decided not to take part in this partnership as it had very little relevance to Lockton.
/02 NYMNP – Parish member appointments
There will be one vacancy for the Southern Area after the Council elections which has to be filled by a Parish Councillor. This election will take place shortly after the Council elections. 
/03 NYMNP – Parish Forum presentation on mobile phone coverage
This has been emailed to Councillors. It indicates that an arrangement will be made to bring mobile phone coverage to various villages including Lockton.
/04 RDC – election details
Notices have already been placed in the village noticeboard. The Parish Council nomination forms were handed out.
/05 RDC – Amendments to register of electors
To file.
/06 NYCC – removal of ‘surplus’ grit bins
NYCC have surveyed the position of grit bins & have produced a list of those bins which they will continue to service. The position of bins was discussed & it was decided that there were bins omitted which were on slopes. These include the bin by the Levisham turnoff, the bin on David Lane & the bins at Saltersgate. The Clerk will email NYCC. Also a note will be put in the next Cryer.
/07 NYCC – Implementation of part 1 of the Commons Act 2006

/09 NY Police – January stats

/10 Forestry Commission – planning for new car park & entrance barriers
The planning is for a new car park at Seivedale. Also there will be 2 pay stations  with barriers at the Pexton Moor entrance & 1 pay station & barrier at Bickley.
/11 HMRC – VAT claim
The letter states the code to be used when completing the VAT claim form. This code has always been used.
/12 Pensions Regulator – workplace pension scheme
All employers have to set up a workplace pension scheme. The Clerk has made some enquiries about this but even when the Clerk is old & on low pay the Clerk still has to be offered the chance to join a pension scheme. The Clerk will complete the online form to be the nominated person to receive all the correspondence. 
/13 Rural Action Yorkshire – Winter weather roadshow
Details noted.
/14 Zurich Municpal – insurance quote form
This was addressed to Lockton & Levisham Parish Council! The Parish Council was insured with Zurich a couple of years ago. The Clerk will complete the form to request a quote nearer to the renewal time. 
/15 Wicksteed – playground equipment leaflet

It was decided not to become a member again this year.

1502/06 Cheques for signing   
/01 J Edenbrow – Clerk’s salary - £400.00
There was some discussion on the Clerk’s pay rate. It was decided that the Parish Council would increase the payment to the rate paid prior to the Council having to pay the Clerk’s income tax.
/02 HMRC – Clerk’s tax - £100.00
This payment had to be increased to reflect the higher salary payment.

1502/07 Planning 
/01 NYM/2014/0827/RM construction of agricultural workers dwelling at Fox & Rabbit Farm

/02 NYM/2014/0830/FL replacement shed at Old Barn Cottage

The tree application for tree pruning has also been granted.
/03 NYM/2014/0685/FL rebuilding of outbuildings to form holiday accommodation East Kingthorpe Granary
This application was discussed. There were no objections. The Clerk will email.

1502/08 New Business
/01 Cemetery  
An enquiry has been made about the purchase of a plot at the cemetery which would be near the central path & so some distance from the current row in use. It was decided that this should not be allowed as it could cause problems with rows out of line in future. It was agreed that the resident could purchase a grave on the next row or the current row if they wished. The Clerk will ring to discuss.
/02 Pot holes
It was reported that the potholes in the Square were getting worse due to vehicles turning in this area. The Clerk will email highways.
/03 Sewage system at the Howl
This system was squeaking yet again. Jennifer will report this to Yorkshire Water.

/01 Undergounding electricity – street lights
The Clerk has still had no response from NYCC Paul Gilmore regarding the installation of the light by Hope House. The Clerk will discuss this with RDC Nicki Lishman to see if she can help. Also the light in the garden next to Box Tree Farm still isn’t working. The Clerk will report this again to RDC.

Janilaine Mainprize couldn’t attend tonight’s meeting but had emailed the Clerk. She was wondering what the Parish Council’s views were on her organizing a Facebook & Twitter page for the village. None of those present use Facebook & the Cryer newsletter is used to give information on events. However it was felt that if Janilaine was prepared to do this, then it would probably be used by the younger residents. The Clerk will email.

/04 Police & Crime Commissioner for North Yorkshire – survey on police precept
There were three options for how the Police precept should be set for the coming year. These were discussed & the preferred option was increasing the precept by 1.99%. The Clerk will complete the survey.
/05 Rural Action Yorkshire – no funding from Defra from 2015-6 – petition
There were fears that the Rural Community Councils would get no funding from Defra for 2015-16 so a petition had been organized. However today it has been announced that there be funding for the coming year.

/01 Grit bins at Saltersgate
It has been reported that the grit bins at Saltersgate have no grit & are full of water. The Clerk will notify NYCC Highways.
/02 Dip in road by Overscarr Lane
The Clerk has reported the dip in the road which seems to have got worse in recent weeks. NYCC Highways replied that the inspector is monitoring the situation.

/01 RDC – fracking presentation
The presentation given on fracking at the recent Parish Liaison meeting is available on RDC’s website.
/02 RDC – Precept for 2015/2016  
A summary of the Parish Council’s current financial position, probable income/expenditure for the rest of the financial year & budget for 2015 was discussed with a view to setting the precept for 2015/16. There will be the loss of income for grass cutting from NYCC & the cost of the street light outside Hope House. It was decided to increase the precept from £2450 to £2820 to cover the loss of income for grass cutting. The form was signed by the Chairman & Clerk. The Clerk will post this.
/03 RDC – Register of Electors 2014

Instead of trying to get volunteers to organize oil buying cooperatives in their villages, RDC & SBC are now running cooperatives where individuals can register.

/09 Lockton Tea Rooms – possible visit to PC meeting
Janilaine Mainprize has emailed to say that she would like to come to a Parish Council meeting to discuss future plans for the Tea Rooms & ways to help the village. She was unable to attend this meeting. The Clerk will email with the date of the next meeting.

This included a note on the NYCC library consultation. The proposal is that each district will have a core library (Ryedale’s would be Malton), some libraries such as Pickering would become hybrid libraries with volunteers working alongside a NYCC employee & the remaining libraries would be managed by the community.

1411/04 Matters arising/ ongoing
/01 Undergounding electricity – street lights
The Clerk had phoned Paul Gilmore again at NYCC. The cost of a street light would be £1090 plus VAT. It would be about £200 cheaper for a street light attached to a house which he, as previously, does not recommend. However a letter has been received from John Norbury in which he says that he thinks that a lamp post would look out of place in that part of the village & would much prefer a light attached to his house. It was decided to ask NYCC for a light to be attached to Hope House & the Clerk will contact John to explain that it was NYCC & not the Parish Council who prefer posts to lights attached to houses.

/03 Grass cutting
The Clerk had firstly met Cllr Geoff Acomb to discuss the Thornton le Dale arrangements for grass cutting using a contractor. They have used John Napthine for several years & are very happy with his work. The Clerk then had met John Napthine & shown him the areas in the village which require cutting. His quote for the work was £150 per cut with probably 10 cuts a year. This is about the same as the current cost of grass cutting, petrol & maintenance costs. It was decided to arrange for John Napthine to carry out the work in 2015. The Clerk will phone to agree the contract.
/04 Trees by Rose Cottage
Chester & Jennifer had met Kath & Aby Broadbent to discuss the overhanging trees. They have agreed to carry out the work by the end of the year.
/05 Tree work in churchyard
David Bayes had had to cancel the work on the tree due to an urgent commitment. He has not yet arranged an alternative date.

/01 NYMNP – Statement of Community Involvement
To file. The Clerk was aware that the NYMNP now charge £10 for pre application advice. The Parish Council had not been made aware of this charge. The Clerk will email about this.
/02 NYMNP - Moors Messenger

/03 NYCC – Remittance Advice for grass cutting
The payment for grass cutting has been received.
/04 NYCC - Changes to Highway Grass Cutting service
This details what grass cutting will be done by NYCC in 2015/2016. There will be limited highway verge cutting only near junctions. A map shows the very limited areas in the village which the Parish Council will be paid for. This means that next year we will be paid £15 for grass cutting compared to £360 we received this year.

/01 Undergounding electricity – street light
The Clerk has spoken to Paul Gilmore at NYCC. He was still waiting for someone to ring him from Northern Powergrid. He would follow this up. It was reported that the street lights up Hudgin Lane & near Box Tree Farm were not working since the undergrounding. The Clerk will make some enquiries. The contractor contacted the Clerk about digging across the churchyard. It is necessary to get permission for this from the York Diocese. This could take some time.
/02 State of church wall
Graham Brown has carried out the repair.
/03 Hedge next to cricket field
Steve Stead has not had time to carry out this work yet.
/04 Grass cutting
The Clerk had not been able to contact Geoff Acomb but will keep trying to contact him.
/05 Parish Cryer
As the printer is having problems printing high volumes because of a page feed problem, a note was put in the last Cryer saying that it would be the last printed copy. The Clerk has been contacted by a few residents requesting an email copy.

There has not been a response yet from the owners.

The questionnaire was completed & the Clerk will input the responses online. There were concerns that care in the community was not suitable in all cases.
/04 YLCA – extract from White Rose Update - registration of Common Land
From December 1st Part 1 of the Commons Act 2006 will come into force in North Yorkshire.

Unfortunately, the Parish Council is unable to make a donation this year.

The cheque from John Corner, funeral directors, was returned unpaid by the bank. The Clerk contacted the funeral directors who said that funds would be available when the bank presented the cheque again.

Trees in churchyard
David Bayes will be carrying out the tree work on the tree nearest Bell Cottage on November 11th. The Clerk will notify neighbours to ensure there are no cars parked in this area. There is to be a funeral later this week & the pavement outside the church is thick in beech nuts & leaves. The Clerk, Jennifer (plus Ray & Tony) will arrange to clear them beforehand. The Clerk will also phone RDC to try to arrange for the street cleaner to come sometime.

/01 Undergounding electricity – street light
The Clerk has spoken to Paul Gilmore from NYCC who says that the cost would be around £600-£700 not £1400 as was stated by RDC. He is not keen on fixing a light on a house as the occupant can always ask for it to be removed & there would be little difference in cost. He has since emailed to say that when one of his colleagues will check out the position when next in the Pickering area & then he will speak to Northern Powergrid. The Clerk will email to ask for a definite price.
/02 Audit
This has now been returned from the external auditors. The Clerk will display a copy in the noticeboard as required. The comment from the external auditor relates to the incorrect entry regarding trust funds.
/03 State of church wall
Ongoing.
/04 Dog fouling
The Clerk has delivered the dog fouling leaflet to every house in the village where there are dogs and also to every holiday cottage. There has been a complaint about dog fouling increasing in Hudgin Lane. No action will be taken as this might be due to holiday makers. The Clerk still has to put up the dog fouling post stickers.
/05 Hedge next to cricket field
The hedge still hasn’t been trimmed. Chester has asked Steve Stead to carry this out.
/06 Grass cutting in 2015
Cllr. Geoff Acomb from Thornton wasn’t able to come to this meeting as he has only recently returned from holiday. He has suggested that the Clerk phones him to arrange a meeting. To discuss contractors. The Clerk will ask residents in the next Cryer if they would volunteer to cut the green outside their house. There has been two graveside burials recently. As the cemetery grass was very long, Tony Edenbrow & the Clerk spent several hours strimming & tidying this up beforehand as George Brown had had problems with the equipment & did not want to continue unless the Parish Council bought a new mower. Tony has offered to cut the grass for the rest of the season with the current equipment. This offer was accepted.

The Clerk has contacted RDC to see if a light could be attached to a house as the residents at Hope House have no objections about this. The Clerk was advised to contact Paul Gilmore at NYCC but has not had a reply to the email yet. The Clerk has also contacted C.Cllr David Jeffels again to see if he has any more information but has not had a reply.

/04 Dog fouling
The Clerk has received some posters, some leaflets & some post stickers from the dog warden at RDC. The Clerk will attach the stickers to posts in different parts of the village. The Clerk will be delivering some church flyers soon so will deliver a dog fouling leaflet to all houses with dogs & also to holiday cottages.
/05 Hedge next to cricket field
The Clerk has spoken to Mr Shepherd who has said that he will trim the hedge as soon as he has the time. Chester has also spoken to him to see if Mr Fox from Levisham can go in his field to trim the worst part of the hedge.

/01 Fly tipping
Chester reported that garden waste had been tipped near the old pond up West Field Lane. There had been fears that this would start when payment for brown bins were introduced. It was decided to keep a record of such instances & to notify RDC if this was happening regularly.

1407/04 Matters arising/ ongoing:
/01 Councillor vacancy 
RDC has emailed to say that no one has requested an election so the Parish Council can co-opt a councillor. Jenny Bentley has said that she would like to become a councillor again. David proposed that Jenny should be co-opted & Jennifer seconded this. 
Jenny Bentley arrived and apologised for being a few minutes late.
Jenny will complete the necessary forms & the Clerk will post these to RDC.
/02 Undergounding electricity – one pole is rotten
RDC have said that the Parish Council will need to pay for a new light pole which is about £1400. Residents living near this light have said that they would like the light to be replaced. Jennifer raised our problem at last week’s Parish Forum. David Jeffels, a NYCC Councillor, offered to look into seeing if there was any help available from NYCC but he has not responded yet. Hawson Simpson said at the Parish Forum that Gillamoor had had this problem & had received a grant towards the cost. The Clerk will contact Hawson for more information.
/03 Audit 
The external auditor had emailed about a discrepancy in the form about trusts & this has now been resolved.
/04 State of church wall
George Brown had made a temporary repair to the wall when he was grass cutting. Graham Brown had seen this & thought that he was no longer needed. He has been asked to improve the repair.
/05 Laptop repair
The laptop has been repaired but all the applications have had to be re-installed. There was no cost for the repair.
/06 Dog fouling
The problem of dog fouling has been raised at RDC’s liaison meeting & a letter has been received with details about ways of dealing with the problem. The Clerk has emailed the dog warden but has not has a response yet.
/07 Hedge next to cricket field
Steve Stead has cleared the verge of tall grass & bottery bush but there is still a problem with the height of the hedge. The Clerk has tried to ring the owner but there is never a reply. If the Clerk cannot make contact this way, a letter will be sent requesting that the hedge is trimmed.
/08 Grass cutting
George has had problems keeping up with the grass cutting. Steve Bentley, Tony & Jackie Edenbrow spent some hours cutting & strimming the verges & cemetery. The equipment was not working very well. Steve managed to improve the mower. Ray Halmshaw spent a day repairing the ride-on mower. However this is now out of action again. Grass cutting needs to be considered for the coming year as there will be no money from NYCC next year & the equipment is getting old. The Clerk will be attending the Thornton ward meeting on Wednesday & will ask advice from other Councils. Thornton have a contactor so it would be useful to find out what the contactor charges

1407/05 Correspondence: 
/01 NYMNP – Southern Parish Forum – agenda
Jennifer & the Clerk had attended this meeting. As mentioned earlier street lighting was raised.
/02 RDC – Individual electoral registration – poster & leaflet 
An A3 notice had been sent which is too large for our notice board so an A4 notice had been requested. This will be put on the village noticeboard. In future every resident will need to register to vote. Currently only the head of the household completes the form.
/03 RDC – Chairman’s charity fund
The Chairman’s charity fund this year is Ryedale Special Families. The Parish Council only considers making a donation directly to the charity.
/04 NYCC – temporary road closure – Hudgin Lane
Hudgin Lane will be closed for up to 5 weeks during cable installation works.
/05 NYCC –charging for disposal of hardcore, rubble & plasterboard Inc. poster    
From August 4th NYCC will charge for hardcore, rubble & plasterboard waste at Thornton tip. The charge will be decided by staff at the tip. The poster will be put on the village noticeboard.
/06 NYCC –vacancy for Ryedale Area Committee – ballot paper 
There were 2 candidates for the vacancy –Paul Andrews from Habton & Christine Dowie from Kirkbymoorside. It was agreed to vote for Paul Andrews & the ballot paper was completed. The Clerk will post it.
/07 YLCA – agenda, minutes, annual review 2013/4 
Details noted. The Annual Review was put on the village hall noticeboard.
/08 YLCA –Revised legal topic note – handling complaints
Details noted.
/09 YLCA –Draft guide to the openness of local government bodies regulations
These regulations will come into force in the near future. They allow the press or public to film, blog etc. on any public meeting of local government bodies.
/10 Coast & Vale Community Action – heritage lottery fund workshop
The details were passed to Jennifer to pass on to Ray Halmshaw for the Heritage group.
/11 Coast & Vale Community Action – Grant funding to promote community safety
The deadline for the first round of this grant has already passed. The second round is September. Some of the projects which may be supported include promoting safety & reducing the fear of crime. The possibility of this grant providing help towards a replacement light pole was discussed. The Clerk find out more details.
/12 NY Police – June stats

/13 Ryedale Community Transport – poster, leaflet, request for volunteer drivers

Helen James from the Yorkshire Energy partnership had wanted to attend the meeting to discuss an oil buying club but had been unable to attend tonight. The idea of an oil buying club was discussed again but there was no interest. The Clerk will email.

1406/04 Matters arising/ ongoing:
/01
Undergounding electricity – one pole is rotten
Undergrounding work has now commenced & the contractor has notified us that one pole (outside Hope House) with a street light on is rotten & will become dangerous without the electricity wires in place. The contractor has asked if we are still require a street light here & if so we will need to arrange for a replacement. Following much discussion it was decided that this area would be very dark without a light & that it should be replaced. It had been discussed at an earlier meeting with Cllr Geoff Acomb that replacement street lights were the responsibility of the Parish Council & could cost around £1000. The Clerk will contact RDC with regard to ownership, the contractor to say a pole was needed & will try to find any funding to cover the costs.
/02 Highways Capital programme 2014/5
There has still not been a reply regarding this item.
/03 Dog fouling/ dog bins
A letter from Tilly Gledhill (age 8) had been in the last Cryer about dog fouling. This is still a problem. The Clerk will contact the dog warden at RDC to see if he can provide signs & any advice.

The internal auditor has completed his checks & the audit form & attachments have been sent to the external auditor before the final date.
/05 Insurance
This has now been renewed for another year.

Jenny confirmed that Graham Brown would repair the church wall.
/07 Councillor vacancy
The Clerk has notified RDC that Chris King has resigned as a Councillor. The Parish Council has to advertise the vacancy to see if any residents wish to have an election. The notice has to be displayed for 14 working days. The Clerk will put the notice on the village noticeboard immediately after this meeting. If 10 or more residents ask RDC for an election, then the Parish Council will have to pay for one. Otherwise the Council can co-opt a new Councillor at the next meeting.

Concerns have been raised that the hedge next to the cricket field is high & is causing a visibility problem at the road junction. The grass verge was also high but NYCC have recently cut this. Steve Stead who is chairman of the cricket club has offered to sort this out.

/01 Undergounding electricity 
An email from NYMNP says that work will commence when the one outstanding wayleaves agreement has been signed.
/02 Sewage blocking drain
Yorkshire Water had replied saying that the open drain was acceptable. This was how some older systems had been installed.
/03 Highways Capital programme 2014/5
There was still no response from NYCC.
/04 Parking 
The response from NYMNP Planning  & NYCC Highways was inconclusive. It was decided not to pursue this further. 
/05 New laptop
The laptop has now been collected & is being used.

Jane Gledhill has offered to write a bit for the next Cryer. David said that he had seen some RDC dog signs. He said he would email the Clerk attaching a photo .

George Brown has offered to cut the grass. The ride-on mower is not working correctly & has been returned to Steam & Moorland. As this has recently been serviced, the Clerk should ensure that this repair is carried out free of charge. Les Welburn has asked if he can put some sheep in the Churchyard. This was agreed & the Clerk will contact him.  An email from NYCC Highways says that there will not be a contribution from NYCC after the current year.
/08 Audit – completion of section 1 & 2 of audit return
Sections 1 & 2 of the audit return were completed. The Clerk will arrange for Stephen Broadbent to carry out the internal audit. Then this audit return plus additional required information will be sent to the external auditor before June 9th.
/09 Insurance
The insurance quote can be reduced if a long term agreement is made. It was decided that the discount was not enough to justify not being able to shop around in future years.

The Clerk has not asked Graham Brown yet about this.

As the cows are not passing the village sign this year, it was agreed to purchase some flowers for around the sign from Barnes Nursaries. The Clerk will arrange this & plant tham.
/03 Policy on filming Council meetings
At the recent Parish Forum attended by Jennifer & Jackie, Rosedale PC raised concerns about filming of Parish Council meetings. A resident had filmed part of their meeting & then put an edited version on Youtube. This had also happened at another Parish Council. It was decided that if anyone tried to film then the meeting would close.
